Kyiv, July 27 (Interfax-Ukraine) – Ukrainian President Viktor Yuschenko has returned a bill on the transfer of privately owned land for social needs to the parliament with his recommendations.

According to the presidential press service report on Friday, Yuschenko said the bill does not stipulated timely solutions to human rights issues and does not meet the constitutional guarantees of private property rights.

Deputy Head of the Presidential Secretariat Maryna Stavniychuk will represent the president in parliament when the bill is discussed.

According to the document, the transfer of a land plot with further full compensation for its value, as well as the value of houses and other facilities and plants located there, should only be applied for the construction of linear objects of transport and energy infrastructure (roads, bridges, flyovers, airports, oil and gas pipelines, power stations etc.) and only if building those objects on such land plots will have a positive effect that significantly outweighs the negative consequences for the owner of the land.

Any decision on such a land transfer is to be made by the courts.

The repurchase of the land plot from a private owner is to be effected with preliminary, and later full compensation.

Land plots may be repurchased from private owners only to support national security, transport and energy infrastructure, industrial and other companies of strategic importance, diplomatic and international organizations, buildings of government bodies and local government, municipal objects and reserve facilities.

The document provides that decisions on repurchasing land will be taken by government bodies and local government officials based on transport and energy infrastructure construction and reconstruction projects, and other documentation.

If the owner refuses to sell the land, the decision on its repurchase will lose legal force in a year.
