Kyiv, August 3 (Interfax-Ukraine) – Ukrainian President Viktor Yuschenko has suspended some articles of cabinet resolutions No. 237 of March 11 and No. 767 of July 24, 3009, which permitted National JSC Naftogaz Ukrainy to buy financial services without holding tenders.

This is stipulated in president decree No. 579/2009 of July 31, which has been posted on the official Web site of the head of state.

The second article of the cabinet resolution of March 11 suspended by the president permits Naftogaz Ukrainy to buy financial services on raising credits to pay for natural gas within the size of indicators of the holding's financial plant, including gas that would be pumped into gas storage facilities, and services on its transportation, pumping and storage; and refinancing of credits which were taken to finance the said expenses in previous years, according to a procedure which implies the singing of agreements with one provider without agreeing it with the Economy Ministry.

The cabinet resolution of July 24, in particular, permitted Naftogaz Ukrainy to buy services of financial consultants outside the standard state purchase mechanism.

"Giving Naftogaz Ukrainy the right to buy the above-mentioned financial services not in line to procedures, which foresee competition of bidders, the cabinet violates the Ukrainian constitution," reads the president's decree.

Yuschenko would challenge the said articles of the cabinet resolution in the Constitutional Court of Ukraine.

As reported, Ukrainian Premier Yulia Tymoshenko on July 29 refuted facts of violation of law in purchase of financial services by Naftogaz.
