HEALTH MINISTRY PROPOSES TO INTRODUCE BANKRUPTCY PROCEDURE FOR HEALTHCARE ORGANIZATIONS, BAN SALE AT AUCTIONS, SAYS DRAFT LAW

Kyiv, August 3 (Interfax-Ukraine) – Ukraine's Health Ministry has proposed to stipulate in a new law the bankruptcy procedure for healthcare organizations, ban their sale at auctions, introduce supervisory boards for them and regulate their activities under a single law.

A draft law on the healthcare organizations has been posted on the official Web site of the Health Ministry for public discussion.

"The activities of state and municipally-owned healthcare organizations and those functioning as budget organizations are regulated in cabinet resolutions in a way that considerably constrains their heads in making decisions to ensure the efficient use of resources and an increase in the quality and accessibility of medical aid," reads an explanatory note to the draft.

The document foresees the division of healthcare organizations into budget, municipal, state and private enterprises, which are not under management of the central healthcare executive power body, the introduction of the notions of "university clinics" and "industrial medical cooperatives" and regulate the participation of nonresidents in the work of healthcare organizations under a separate law.

The draft, in particular, bans nonresidents that are not registered as legal entities from providing medical aid, apart from cases they are invited to do so by the president, cabinet and parliament.

The draft also regulates leasing relations between healthcare organizations and private companies. Industrial medical cooperatives and private businessmen can use property and premises of healthcare organizations only under leasing agreements on a paid basis.

The draft says that private healthcare companies are banned from using leased property and premises of healthcare organizations during their operational time and from using such property and premises for providing emergency first aid.

"The realization of the draft foresees the improvement of a procedure for the organization of health treatment services to the public and activities of healthcare organizations, the increase of the quality and safety of medical services, the introduction of contract relations between suppliers of medical services and those who ordered them, and the creation of mechanisms for the rational use of financial, personnel and material-technical resources in the sector," reads the note to the draft.
