AMCU PROPOSES TO INTRODUCE STATE REGULATION OF FEES FOR AIRCRAFT REFUELING

Kyiv, August 3 (Interfax-Ukraine) – The Antimonopoly Committee of Ukraine (AMCU) has proposed to introduce state regulation of services for aircraft refueling at Ukrainian airports.

The acting head of the committee, Oleksandr Melnychenko, said that the drawing up of the document is one of the requirements set by the committee to Ukraine's Transport and Communications Ministry.

Melnychenko said that an investigation carried out by the committee showed that the aircraft refueling market appears to be a natural monopoly, so it needs state regulation.

Among other recommendations of the committee are the approval of a list of airport services on the natural monopoly service markets; the settling of the issue of the technological integration of land services providers at airports; the drawing up of a procedure for the selection of aviation fuel suppliers on a tender basis and a procedure for regulation of the conditions of access to the land service markets.

According to a press release issued by the committee at its meeting, the committee is investigating an abuse of monopoly at Boryspil International Airport, which led to unjustifiably high profitability (over 230%) in fees for terminal services and the setting up of artificial obstacles by the airport to access to the aircraft and passenger land servicing markets.

In addition, Melnychenko told the press that at present, Ukrainian-Dutch company CJSC Krebo and CJSC Ukrtatnafta (both based in Kremenchuk in Poltava region), and OJSC Luk-Avia Oil (Boryspil in Kyiv region) are challenging in court a committee decision to fine the companies UAH 225 million for abuse of monopoly on the aircraft refueling market at the Boryspil airport.

Melnychenko said that the committee would demand that the fines be paid, adding that court hearings on the case have not taken place.
